These Terms & Conditions ("Terms") govern your access to and use of the Enthiram.AI website and products, including FirePencil and other Enthiram agents (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.
1. Use of the Services
You may use the Services only in compliance with these Terms and all applicable laws. You are responsible for any activity carried out through your access to the Services and for ensuring that anyone you authorise also complies with these Terms.
2. Accounts and access
Some features may require you to provide information or join a waitlist. You agree to provide accurate, current information and to keep any access credentials confidential. You are responsible for activity that occurs under your access.
3. Beta and early-access products
Certain products, including the FirePencil Beta, are offered on an early-access basis. Beta features are provided "as is", may change or be discontinued at any time, and may contain limitations or errors. We make no guarantees regarding the availability, performance, or results of beta features.
4. Third-party integrations
The Services may connect with third-party platforms (such as analytics, advertising, e-commerce, and data tools) at your direction. Your use of those platforms is governed by their own terms, and we are not responsible for their availability, content, or practices. You are responsible for ensuring you have the necessary rights and permissions to connect them.
5. Acceptable use
You agree not to misuse the Services, including by attempting to gain unauthorised access, interfering with their operation, using them to violate any law or third-party right, or using them to transmit harmful, unlawful, or infringing content.
6. Intellectual property
The Services, including all related software, content, branding, and materials, are owned by Enthiram.AI or its licensors and are protected by applicable intellectual property laws. These Terms do not grant you any right to use our trademarks or content except as necessary to use the Services as intended.
7. Disclaimers
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or produce any specific business outcome.
8. Limitation of liability
To the maximum extent permitted by law, Enthiram.AI and its founders, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the Services.
9. Indemnification
You agree to indemnify and hold harmless Enthiram.AI from any claims, damages, liabilities, and expenses arising out of your use of the Services or your breach of these Terms.
10. Termination
We may suspend or terminate your access to the Services at any time if you breach these Terms or if we discontinue the Services. Provisions that by their nature should survive termination will continue to apply.
11. Governing law
These Terms are governed by the laws of India, without regard to its conflict-of-laws principles. Any disputes arising out of or relating to these Terms or the Services will be subject to the exclusive jurisdiction of the competent courts in India.
12. Changes to these Terms
We may update these Terms from time to time. Changes take effect when posted, as indicated by the "Last updated" date above. Your continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
